Rights of an arrested person in India before and after | Every Indian should know their rights
Sometimes police can arrest you because of personal and greedy reasons. So we should know what are our rights. A person who is getting arrested by police in India has its own rights. These rights are written in the Constitution of India.
2. Police need to inform the relative or friends of the person they are arresting within 12 hours of arresting. Section 50 A. If the police are not coordinating well then the family member of the arrested person should complain Police SP.
Or an arrested person relative can hire a lawyer and file an appeal in High court.
If no one is helping then you can take the help of media.
3. Police must produce the arrested person in front of the Magistrate within 24 hours of arrest. Article 22 (2) and section 76.
4. An Arrested person can consult with his lawyer even while in police interrogation. After consulting with a lawyer, then an arrested person can proceed further. Section 41 D.
While in police interrogation you can sit with your relative or lawyer. It's your right.
5. An Arrested person can request his detailed medical examination within 24 hours of arrest.
6. An arrested person has a right to be released on bail.
7. If an arrested person can not afford a layer then the government will provide the layer for him free of cost.
8. A woman can only be arrested by a lady constable only before sunset and after sunrise except In serious crime. Police need to show an arrest warrant in that case or permission from a magistrate.
