What to do if someone files a false FIR against you

Sometimes police can arrest you on a false FIR. They will do it because of personal and greedy reasons. Or maybe your enemy files a false FIR against you. Reason can be anything. 



So what you can do in this case? You don’t have done any crime but still, police make an FIR or a false case.

First, you need to get bail with the help of a lawyer.  

How we going to deal with that case in a legal way?


1. You can just prove to the police that you are innocent. Then now if it will get prove that you are innocent and the FIR is false, you can file a case on that person who files false FIR.

You can file a case on and these are the punishment -

IPC 182 - 6 months jail or fine or both.

IPC 211 - 2 Years jail or fine or both

2. Now if the police are not helping you you can do this. Here we will use Section 482 from CrPC.

In section 482 you need to go nearest high court and make an appeal with the help of a lawyer. With your appeal, you can submit proof of your innocence. You should attach anything like video, audio, pictures, and a paper.

Till your case in high court Police can not do anything to you. No arrest no interrogation.

If anyhow you are not satisfied with the high court result then you can go to the Supreme court.
